FATAL VEHICLE VS PEDESTRIAN ACCIDENT

On February 20, 2018, at approximately 1:59am, Stockton CHP responded to a traffic collision vs a pedestrian on northbound I-5 south of Roth Rd. In the initial investigation, it was determined a 49-year-old male from Martinez CA, became disabled with a flat tire on northbound I-5 south of Roth Rd.

The driver of the disabled vehicle parked on the right shoulder and activated the hazard lights. The male from the disabled vehicle, appeared to be walking just north of his vehicle in the #3 lane near the fog line. A 2000 Buick, driven by a 57-year-old male from Stockton, was driving northbound I-5 in the #3 lane approaching the pedestrian at approximately 70 MPH. Due to the pedestrian walking in the lanes of traffic, wearing dark clothing in an area with no lighting, the driver of the Buick was unable to perceive and react to him.

The right front of the Buick struck the pedestrian in the #3 lane. Due to the force of the collision, the pedestrian traveled through the windshield of the Buick and came to rest in the front passenger seat. The driver of the Buick immediately pulled to the right shoulder and called 911. As a result of this collision, the 49-year-old suffered fatal injuries and the driver of the Buick suffered minor injuries in which he was not transported to the hospital for.

Alcohol and/or drugs were not a factor with the driver of the Buick;however, it is unknown at this time if it was a factor with the pedestrian.
